The participant(s), for themselves their executors, administrators and assigns release and indemnify the organisation
- From all and any claims for compensation or loss, damage, injury or inconvenience and from all actions, suits, proceedings, claims, accounts, demands, costs and expenses;
- Against all such claims and other actions by any person including any person claiming an interest as owner, partner, share farmers, mortgagee or otherwise whether in the land of the transferor and/or transferee or the crops or produce there from or in respect of any other matter howsoever arising
- (a) in respect of the registration or failure to register any bid or offer to sell or purchase temporary water on the exchange; and
- (b) the sale or failure to sell any water or the sale or water at any particular price; and
- (c) any other matter, act, thing or circumstance relating directly or indirectly to the operation of the exchange.
Murrumbidgee Valley Trade Ballot Murrumbidgee Water Exchange – Monday 24th August 2009.
The Office of Water is allowing water trades out of the Murrumbidgee Valley via a trade ballot. The first ballot will open on 24 August 2009 with 70,000 mega litres of water available to be traded out. This ballot will close 3.45 pm Friday 4th September 2009.
There is no limit on the number of applications a licence holder may enter in the ballot but each applicant will be limited to 15 per cent of entitlement.
The Murrumbidgee Water Exchange will operate under the following process for trade out of the Murrumbidgee Valley whilst the ballot system is in palace:
- Buyer bids will be registered and processed on Murrumbidgee Water Exchange
- Once buyer and sellers have been matched – buyers will be sent an invoice with 2 days for payment. All fees and charges relating to the trade will be raised on this invoice and will be payable.
- All necessary paperwork will be obtained from the relevant authorities.
- Once all paperwork is received and signed it will be electronically submitted to NSW State Water, this trade will then be placed in the ballot system.
- Once the ballot has been drawn NSW State Water will notify Murrumbidgee Water Exchange if the trade was successful in the ballot system.
- If the trade is successful the Interstate paperwork will then be submitted to the relevant state authority.
- If the trade is unsuccessful in the ballot system the Buyers and Sellers will be notified and a full refund of fees and charges will be processed to the buyer within 7 working days.
- Unsuccessful Buyers and Sellers will automatically be relisted on the Murrumbidgee Water Exchange using the date the Buyer / Seller Form was originally submitted, allowing them to retain their position on the exchange listing.
- Murrumbidgee Water Exchange will not charge any processing fees to trades that are unsuccessful in the State Water Ballot
- In the situation where a buyer bid from outside the Murrumbidgee Valley is registered, but the Office of Water do not have a current ballot open, preference will be given to an internal Murrumbidgee Valley Buyer who has a bid registered for the same amount.
How it Works
Water sellers list water for sale on the exchange, nominating quantity available and price.
Water buyers list bids, also nominating price and quantity demanded. As a buyer or a seller you can watch the market and alter your bids by submitting the appropriate form - see forms.
When the bids match up, a sale is registered, buyer payment is requested within 2 days, and transfers are processed.
A buyer bid indicates your intention to purchase water up to and including the nominated price. If water is available on the Murrumbidgee Water Exchange for less than your nominated price you can purchase water at the price listed. All or part of any parcel can be purchased.
Bids and listings are listed in order of price and then in order of receipt.
The Murrumbidgee Water Exchange operates Monday to Friday.
Bids to buy and sell will be procesed on receipt; the Exchange website is updated during normal bussiness days.
When the transfer/s has/have been approved for the full parcel sold, payment is made to the water seller within ten working days.

Murrumbidgee Water Pool
The Murrumbidgee Water Pool operates by pooling small individual parcles of water to enable water buyers achieving the amount of water they need in one "dealing".
